Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of MauticInsights (the “Service”), operated by Lukáš Drahý, Chudenická 1059/30, 102 00 Praha 10 - Hostivař, Czech Republic, Company ID (IČO) 87439077 (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

MauticInsights provides analytics, monitoring, alerting, and reporting for Mautic instances you connect through our plugin. The Service may evolve over time, and features may be added or removed as it develops.

3. Accounts

You are responsible for the accuracy of your account information, for keeping your credentials and ingest tokens confidential, and for all activity under your account. Notify us promptly at hello@mauticinsights.com of any unauthorised use.

4. Your responsibilities and the data you connect

You may only connect Mautic instances you are authorised to monitor. For personal data of contacts in those instances you act as the data controller and we act as your processor; our processing is described in the Privacy Policy. You are responsible for having a lawful basis for the data you send us and for honouring the rights of your contacts.

5. Acceptable use

You agree not to misuse the Service, including by attempting to breach security, disrupting the Service, reverse-engineering it except as permitted by law, reselling it without authorisation, or using it to process data unlawfully.

6. Fees

The Service is currently available free of charge. Paid plans and pricing will be communicated before they take effect; continued use after that constitutes acceptance of the applicable fees.

7. Intellectual property

We and our licensors retain all rights in the Service and its software. Our plugins that are released as open source are licensed under their respective licences. You retain all rights in the data you connect.

8. Availability and support

We aim for high availability but the Service is provided on an “as available” basis and may be subject to maintenance or interruptions. Support is provided on a reasonable-efforts basis via hello@mauticinsights.com.

9. Termination

You may stop using the Service and delete your instances and account at any time. When you remove an instance, its stored events, request logs, and metrics are deleted from our database. We may suspend or terminate access for breach of these Terms or to protect the Service.

10. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that alerts will detect every issue.

11. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

12. Changes to these Terms

We may update these Terms. We will notify you of material changes by email or in-app at least 30 days in advance where practicable. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the Czech Republic, and disputes are subject to the exclusive jurisdiction of the courts of Prague, Czech Republic, without prejudice to mandatory consumer protections in your country of residence.
